Conflicto de competencia suscitado entre el Juzgado Sexto Civil Municipal de Ibagué y el Juzgado Promiscuo Municipal de Rioblanco (Tolima), en torno al trámite de la acción de tutela de la referencia.
En el presente caso consideró la Corte que, respetando la elección que “a prevención” realizó la demandante, se debe resolver la controversia ordenando remitir el expediente al Juzgado Sexto Civil Municipal de Ibagué, para que, de forma inmediata tramite y profiera decisión de fondo respecto del amparo solicitado, conforme a las previsiones del artículo 86 de la Constitución Política y del Decreto 2591 de 1991.
